WHAT IS RIGHT TO INFORMATION ACT

The Government of India has enacted? Right to Information Act 2005? to provide for setting out the practical regime of right to information for citizens and to secure access to information under the control of Public Authorities in order to promote transparency and accountability in the working of any public authority.

WHAT IS RIGHT TO INFORMATION

The right to information includes an access to the information which is held by or under the control of any public authority and includes the right to inspect the work, documents, records, taking notes, extracts or certified copies of documents/ records and taking certified samples of the materials and obtaining information which is stored in electronic form

WHO CAN ASK FOR INFORMATION

Any citizen can request for information by making an application in writing in English / Telugu / official language of the areas, in which the application is being made together with the prescribed fees

WHO WILL GIVE INFORMATION

The State Public Information Officer (SPIO) of APSPDCL Corporate Office who will receive the requests for information from the public and the State Asst. Public Information Officers (SAPIO) in all Operation Circle Offices of APSPDCL and arrange for providing necessary information to the public as permitted under the Act. The Appellate Authority, who will entertain and dispose off appeals against the decision of the SPIO/ SAPIO as required under the Act. Any person who does not receive the decision from SPIO/ SAPIO wither by way of information or rejection within the time frame, may within 30 days from the expiry of period prescribed for furnishing the information or 30 days from the date of receipt of the decisions, prefer an appeal to the Appellate Authority.

THE INFORMATION, WHICH IS EXEMPT FROM DISCLOSURE

The Act provides under Sections 8 and 9, certain categories of information that are exempt from disclosure to the citizens. The public may also refer to the relative sections of the Act before submitting a request for information.

PROCEDURE FOR REQUEST OF INFORMATION:

Any request by any person seeking information shall be made in writing in any Official Language to the State Public Information Officer (SPIO)/SPIOs specifying the particulars of information sought by him either in English or in any Official language of the local area along with the prescribed fee.

The person requesting for information need not give any reasons.

PAYMENT OF PRESCRIBED FEE:

As per the G.O. No. 454 Dated: 13.10.2005 issued by Govt of AP under Rule 3, a request for obtaining information under Sub- section (1) of section 6 shall be accompanied by an application fee by way of cash or by demand draft of by banker? cheque payable to the Accounts officer/CPR or any other duly authorized officer of the Public authority,(SPIO or SIPIO) against proper receipt, at the following rates:

in respect of public authorities at the village- No fee:

in respect of public authorities at Mandal level - Rs. 5/- per application

in respect of public authorities other than covered above -Rs.10 per application For providing information under sub-section (1) or sub-section (5) of section 7, a fee shall be charged, by way of cash or demand draft or bankers? cheque, payable to the Accounts Officer/CPR or any other duly authorized officer of the Public Authority(SPIO or SAPIO), against proper receipt, at the following rates:-

Publication printed matter, text, maps, plans, floppies, CDs, samples, models or material in any other form, which are priced, the sale price thereof:

Inspection of records ? on fee for the first hour; and a fee of rupees five for each fifteen minutes (or fraction thereof ) thereafter;

Payment towards cost of information provided for:

If the information sought for is furnish - able by the SPIO/SAPIO, the person concerned has to pay the actual cost of the printing of the information. The calculation details of the cost may have to be provided to the applicant in writing. It is to be noted that the Applicant can seek review of the decision on fee charged by the SPIO/SAPIO by applying to the Appellate Authority i.e. General Manager/HRD /APSPDCL

Exemption for payment of Application Fee and cost of expenditure incurred in providing the information, in certain cases.

Applicants who are below poverty line are exempted from paying Application fee and cost of expenditure incurred in providing the information.

RESPONSE TIME TO PROVIDE THE INFORMATION:

48 hours from the time of receipt of application concerning the life and liberty of person

30 Days from the date of application.

5 Days If the information sought for by the public relates to another Public Authority the request should be transferred to such Public Authority not later than 5 days of receipt of such request.

40 days If the interest of a third party is involved.

GROUNDS FOR REJECTION AND INFORMATION MANUAL:

The State Public Information Officer/State Asst. Public Information Officer of APSPDCL may reject a request for information where such a request for providing access would involve an infringement of copyright subsisting in a person other than the State.
